What is the TCPA?
The Telephone Consumer Protection Act (47 U.S.C. § 227) restricts telemarketing calls, auto-dialed calls, pre-recorded calls, and text messages. It creates a private right of action — you can sue the caller directly.
How Much Can You Recover?
- $500 per violation — each illegal call or text is a separate violation
- $1,500 per violation — if the court finds the violation was willful or knowing (treble damages)
- No cap on total damages if multiple calls received
- Attorney's fees may be awarded in some state statutes
